Terms of Service

The terms that govern use of this website and our marketing, email, and SMS programs — including those operated under the Funded by Tapia brand.

These Terms of Service ("Terms") govern your access to and use of massappealmarketing.com (the "Site") and the marketing, lead-generation, email, and text-messaging programs operated by Mass Appeal Marketing LLC ("Mass Appeal Marketing," "we," "us," or "our"), including programs operated under the Funded by Tapia brand (together, the "Services"). By using the Site or Services, submitting a form, or opting in to our communications, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or Services.

1. Who we are — and who we are not

Mass Appeal Marketing LLC is an independent B2B marketing and lead-generation company. We are not a lender, mortgage broker, or loan originator. We do not originate loans, extend credit, quote rates, make credit decisions, or provide lending, legal, financial, tax, or investment advice. Any loan program described on the Site or in our communications is offered by independent, licensed lending partners and is subject to their application, underwriting, and approval processes. Not all applicants will qualify. Program terms, rates, and availability are determined solely by the lender and are subject to change without notice.

2. SMS / text-messaging terms

By providing your mobile number and opting in — for example by checking a consent box on a web or social-media lead form, by texting a keyword to us, or by otherwise agreeing in writing — you consent to receive recurring automated and non-automated informational and promotional text messages from Mass Appeal Marketing LLC, including messages sent under the Funded by Tapia brand, at the mobile number you provided. Consent to receive text messages is not a condition of purchasing any goods or services.

Program description

Messages may include: responses to your inquiry and qualification questions about real estate financing programs (such as DSCR, HELOC, bridge, and fix-and-flip financing); appointment confirmations, reminders, and scheduling follow-ups; and, where you have opted in, periodic marketing updates, new program announcements, and digital guides (such as The Modern Equity Blueprint).

Message and data rates may apply. Check with your wireless carrier for details about your plan.

Opt-out

You can cancel at any time. Reply STOP to opt out. After you text STOP we will send you one final message to confirm that you have been unsubscribed, and you will no longer receive text messages from us. To re-join, reply START or opt in again through one of our forms.

Carriers

Supported carriers include AT&T, T-Mobile, Verizon, US Cellular, and most other major U.S. carriers. Carriers are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission from your network operator and processing by your mobile device.

Privacy

Your mobile number and opt-in data are used only to deliver the messages you agreed to receive. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

3. Calls and email

By submitting your telephone number on a form you also agree that Mass Appeal Marketing LLC and the licensed lending partner we refer your inquiry to may contact you by phone (including by pre-recorded or automated means where you have consented) and by email at the contact details you provided, for the purpose of responding to your request and, where you have opted in, for marketing. You may revoke this consent at any time by following the opt-out instructions in our Privacy Policy.

4. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. By submitting a form you represent that the information you provide is accurate and that you are the owner or authorized user of the phone number and email address you provide.

5. Acceptable use

You agree not to use the Site or Services to: violate any law or regulation; submit false, misleading, or fraudulent information; interfere with or disrupt the Site; attempt to gain unauthorized access to any system or data; scrape, harvest, or copy content or data without our written permission; or infringe the rights of others.

6. Intellectual property

The Site and its content — including text, graphics, logos, the Mass Appeal Marketing and Funded by Tapia names and marks, and the underlying design and code — are owned by or licensed to Mass Appeal Marketing LLC and are protected by copyright, trademark, and other laws. You may view and print pages for your personal, non-commercial use. Any other use requires our prior written permission.

7. No guarantees; informational content

Descriptions of our model, capabilities, case studies, and approach are for informational purposes only and do not guarantee any specific result. Outcomes vary by market, offer, and partner. Nothing on the Site constitutes an offer to lend, a commitment to lend, or a guarantee of loan approval, and nothing on the Site constitutes legal, financial, tax, or investment advice. Consult your own qualified advisers before making any decision.

8. Third-party services and links

The Site may contain links to, or integrate with, third-party websites and services (including lending partners, scheduling tools, and social-media platforms). We do not control and are not responsible for their content, terms, or privacy practices. Your use of those services is governed by their own terms.

9. Disclaimer of warranties

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MASS APPEAL MARKETING LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US FOR THE SERVICES GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold harmless Mass Appeal Marketing LLC and its members, managers, employees, agents, and partners from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or Services, your violation of these Terms, or your violation of any law or the rights of a third party.

12. Governing law and disputes

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction of those courts. To the extent permitted by law, you agree that any claim must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

13. Changes to these Terms

We may update these Terms from time to time. The "last updated" date at the top of this page indicates when the Terms were last revised. Your continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms.

14. General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms, together with our Privacy Policy, are the entire agreement between you and Mass Appeal Marketing LLC regarding the Site and Services. Business clients who engage us under a separate written agreement are governed by that agreement where it conflicts with these Terms.
